Power of Appointment

Where the testator of a will or settlor of a trust gives a third-party (the "Power Holder") the ability to determine final distribution of the testator's or grantor's assets. There are two types of Powers of Appointment: (1) General and (2) Limited. A Power of Appointment is usually exercised in the Power Holder's will.
