Testamentary Trust

A trust provision found in an existing will or trust and created/funded after the death of the person who created the will or trust. Testamentary Trusts only exist upon a person's death and are for the benefit of another person (usually their children). Testamentary Trusts can be created for any valid purpose and serve to protect assets for the benefit of the beneficiaries.
